The NCLAT has dismissed the appeal filed by the suspended director of Suumaya Industries Limited, upholding the previous order from the NCLT that admitted a Section 7 application by the financial creditor. The case revolves around a loan of ₹5 crore taken in October 2020, where significant default issues emerged, including an outstanding amount reported as ₹4.4 crore. A Memorandum of Understanding allowed shares to be pledged against the loan, yet subsequent sales did not cover the debt. The NCLAT confirmed the existence of both debt and default, noting that the financial creditor had not discharged its obligations despite earlier attempts to negotiate a settlement. The tribunal also commented on potential future settlements between the parties and the possibility of withdrawing the corporate insolvency resolution process if an agreement is reached.
