SKIL Infrastructure Limited's application for Corporate Insolvency Resolution Process (CIRP) was admitted by the NCLT, marking the company as under significant financial distress. The interim resolution professional reported that the creditors' committee's formation was stayed, hindering the funding process for the CIRP.
Recently, the company faced an adjudication order from SEBI due to multiple violations, including misrepresentations in financial statements for FY 2019-20. It was noted that SKIL did not account for substantial interest liabilities, leading to a reported loss of ₹1,411 crore. The financials failed to reflect a true and fair view due to this misrepresentation. Moreover, there were delayed disclosures related to the Bombay High Court orders and anomalies in consolidating finances from associate companies, resulting in additional penalties.
Nikhil Gandhi was fined ₹15 lakh, while Bhavesh and Shekhar Gandhi were each penalized ₹20 lakh, underscoring their accountability in the financial mismanagement of the company.
